DURANT, Okla. (KTEN) — The preliminary hearing for Ryan Capps has been pushed back. 

The former Durant Public Schools employee was charged with child sexual abuse in 2022. This is the third time his hearing has been rescheduled as federal investigators are now looking into the case. 

It is alleged that Capps, now 25, had been involved in an inappropriate relationship with a 14-year-old girl. 

According to the Choctaw Nation of Oklahoma, the preliminary hearing will continue to be delayed until federal litigation is concluded. 

In a statement provided to KTEN by Choctaw Nation Prosecutors Office:

"Right now, Choctaw Nation of Oklahoma has deferred its prosecution of Mr. Capps' crime in tribal courts as a courtesy to our federal law enforcement partners who are preparing to prosecute Mr. Capps for the same, or substantially similar charges."
