Double Jeopardy Appeal In Denison Arson Murder Conviction

DALLAS, TX -- Judges in Dallas are considering an appeal of a Denison murder case that argues double jeopardy.

Last October, a jury found John Saxon, 31, guilty of both murder and arson in the death of his mother in her Loy Lake Road home, and he was sentenced to 80 years in prison.

Now, his attorney says "death by fire" was argued in both counts, similar to being tried twice for the same crime.

The prosecution argues the same elements were not in both counts as the judge charged them to the jury. The defense wants the case dismissed or one of the counts deleted.
