First degree burglary
On 11-22-2008 at approximately 0118 hours I, Officer McEachern, was dispatched to 12XX W. Alabama in reference to a burglary. Upon arriving at the above location I contacted Lisa Martinez who advised me the following information.
On 11-22-2008 Martinez advised that she had returned home from Salita's restaurant at approximately 2300 hours on the night before and found her ex boyfriend and the father to her two children, Rey Perez, inside her home. Martinez states that she told Perez to leave and he did as she had asked. Rey Perez then came back to that residence wanting to see the children at approximately 0100 hours. Martinez would not let Perez in the house so he pulled the trim off of a front window and pushed the window into the living room floor breaking it. Martinez stated that when Perez was entering her home through the window she ran out the front door and went to a neighbor's house to call the police.
Martinez also advised that she had allowed Perez to stay at the house to see his children on another occasion but that he did not live with her at 1210 W. Alabama and he did not have any personal items at that residence. Perez had been over to the house earlier in the week and Martiez would not let him in the residence at that time as well. She stated that Perez had slept in her truck out in the driveway on that occasion.
I did observe the front window on the West side of the residence facing North broken, lying in the living room floor. The trim to the window was located in the grass under the window in the front yard. I did not observe any other damage at that time. I advised Martinez that a copy of the report would be on file at the Durant Police Department. Photos of the damages were taken and placed into evidence at the Durant Police Department.
Warrant service
On 11-02-2008 at approximately 2158 hours I, Officer McEachern, was dispatched to 14XX West Main (First United Bank) in reference to a suspicious person checking the doors of vehicles in the parking lot. Upon arriving at the above location I contacted Sandra Jones. I checked Jones status through Durant Communications Center and was advised that she had a valid, active, traffic warrant issued by the District Court of Bryan County. I advised Jones that she had a warrant for her arrest and arrested her on the authority of the warrant. Jones was placed in double locked handcuffs and escorted to the front seat of my patrol car where she was placed in an upright sear belted position. Jones was then transported to BCSO where I served her with a copy of the warrant.
Possess CDS and paraphernalia
On December 03, 2008 at 0236 hours, I, Sgt. Jim Smarr, while on patrol in Carl Albert Park, observed a white Ford pickup parked near the tennis courts. I drove near the pickup to see if it was occupied since the park is closed from midnight to 0600 hours.
As I neared the pickup, a male subject, later identified as John Allen, appeared from behind a tree just to the west of the pickup. Mr. Allen was wearing brown coveralls and had a gaze on his face like he was looking through me. Mr. Allen appeared to have been surprised by my presence. His hair was messed up and he would repeat my questions back to me before answering them. I asked Mr. Allen what he was doing and if he had any identification. He stated that he was using the restroom, and that he had identification but that it was in his truck. He asked me if I wanted him to get it, I stated yes. He walked to the driver's side door and stopped. He turned around and looked at me and asked me if I wanted him to get his license now?, I stated that I did. He opened the door and reached in side the truck. I moved to the front so that I could see through the windshield. When Mr. Allen moved to use his body to block my view, I ordered Mr. Allen out of the vehicle and to move to the back of his truck. I radioed for Officer Walker to assist me. While waiting for Officer Walker to arrive, I had to tell Mr. Allen several times to keep his hands out of his pocket.
When Officer Walker arrived, he and Officer Jason Colvard patted Mr. Allen down for weapons. Officer Colvard felt an object in Mr. Allen's right breast pocket. Officer Colvard asked Mr. Allen what the object was and Mr. Allen stated that it was a piece of chalk or a pen. Officer Walker asked if he could retrieve it, and Mr. Allen said no but that he would take it from his pocket. Mr. Allen reached into his right breast pocket with his right hand and retrieved a glass pipe that appeared to have white residue in it. He had it cupped in his hand and stated, "See, its a piece of chalk". When Mr. Allen moved his hand back to his right breast pocket, Officer Walker grabbed Mr. Allen's right hand. I attempted to grab Mr. Allen's left hand, but Mr. Allen turned toward Officer Walker. I grabbed Mr. Allen around the shoulders and neck area and turned him back towards the pickup. When Mr. Allen was turned back around I was able to secure his left arm and he was placed into handcuffs.
Once Mr. Allen was secured the glass pipe was removed from his right breast pocket. The glass pipe had a white residue in the stem of the pipe. The pipe was secured in my patrol car and later placed into the evidence safe at the Durant Police Department and will be sent to the OSBI Lab for further testing and identification.
During the inventory of Mr. Allen's vehicle, the following items were found. A loaded .22 caliber rifle was located in the back seat of the pickup. The weapon had twelve rounds in the magazine, and one in the chamber. In the center console of the pickup was found a Husky brand tobacco can. Inside the can were three medium size zip its containing a white powdery residue. The white powdery residue later field tested positive for Methamphetamine at the Durant Police Department. In the passenger seat was a set of working digital scales containing a white residue.
